Termination of employment by an authorised signatory
Code: PRSK00088
Question
Can the company’s authorized signatory give me notice of termination of employment on the grounds that the managing director is on holiday?
The answer
An authorized signatory is not a statutory body of the enterprise; his position can be defined as a specific way of representing the entrepreneur externally. An authorized signatory does not perform any of the activities that a statutory body performs within the enterprise. It follows that the authorized signatory is not legally entitled to dismiss an employee. However, there may be situations where the person acting as an authorized signatory also holds another position in the company from which such an entitlement may arise. Therefore, each case must be examined individually.
