Liability of the hotel in the event of theft of items
from a car parked in the hotel car park
Code: OBSK00093
Question
We stayed in a guest house which had a car park. During the night our vehicle was broken into and our belongings were stolen. I read about the liability for the belongings brought in. Is the company obliged to compensate us for the damage we suffered as a result?
The answer
The accommodation provider is liable (with exceptions) for damage to property brought in by guests. Items brought in are deemed to be those brought into the premises intended for accommodation or for the storage of items or handed over to the operator or his staff for this purpose.
The operators of garages and similar facilities shall be liable in the same way as the operators of accommodation establishments for the means of transport and their accessories located therein.
In order to assess the liability of the accommodation provider, it is necessary to take into account where the parking space was located and what items were stolen from the vehicle. A good lawyer will always help to assess the particular circumstances of the case.
