Question
I had a loan from a bank, it remained for about 3 years. As a result of my illness, I was late in paying the loan, as a result of which the bank let me pay the entire loan at once. I paid the loan, but the bank also asks for interest for the next period, even though I paid the loan. Is the bank entitled to aqsk for it?
The answer
If interest is agreed in the loan contract for the duration of the loan, the bank is entitled to the interest. In the event of early repayment of the loan, the bank is entitled to interest for the period agreed in advance in the loan agreement. Only an agreement that includes the payment of the agreed interest up to the payment of the principal amount would be ineffective. We also emphasize the need to distinguish between interest (e.g. loan repayment) and default interest (penalty for late payment). Default interest on late payment is entitled (also in addition to interest) for the entire period of late payment. In the event that the bank acts against this, we recommend that you consult a good lawyer.
