Question
The shop I entered was very wet when I came in as it was snowing outside. Shortly after entering, I slipped and fell, sustaining a serious shoulder injury. Am I entitled to compensation?
The answer
As a general rule, compensation can be claimed in the event of damage to health. In the case of the heavy snowfall mentioned above, the operator of the shop is obliged to take "precautionary measures" to prevent accidents caused by slipping on the shop premises. This includes, for example, placing a warning sign or other notice in a conspicuous place, placing rugs to clean shoes, etc. It therefore depends on the circumstances of the individual case whether there has been a breach of the shopkeeper’s duty to prevent damage. You should consult an expert - ideally a lawyer specialized in this field.
