Question
In our company was an work inspection carried. It found a violation of the illegal employment contract in relation to a self-employed person who worked for us. What are the consequences?
The answer
If illegal employment is also established in an administrative procedure and if such a decision becomes final, the enterprise will be included in the public list of enterprises that have violated the prohibition of illegal employment. Further consequences of illegal employment are in particular:
- the imposition of a fine (which may be higher in the case of repeated violations),
- the impossibility to benefit from short-time work during a certain period of time,
- restriction of the possibility to employ third-country nationals during the specified period.
It is therefore advisable to consult a good lawyer already during the labour inspection. Having adequate legal counsel also increases the chances that the employer will be successful in a judicial review of the procedure and the Labour Inspectorate’s decision.
