We want to renovate the apartment, what do we have to pay attention to in the contract?
The answer
The renovation of an apartment or a family house falls under the provisions of the work contract. The most common errors in contract documentation include:
- insufficiently detailed subject of reconstruction (i.e. what work will be carried out),
- poorly defined price terms (in particular with regard to what is included in the price, whether the price is final or can be adjusted and under what conditions),
- incorrectly set payment terms (e.g. down payment too high),
- vaguely defined benefits and the process of their negotiation,
- indefinite completion date,
- lack of definition of the method to control the implementation of the reconstruction,
- insufficiently defined mutual rights and obligations,
- insufficiently regulated liability for defects and lack of warranty provisions,
- lack of sanctions for breach of contractual obligations,
- unclear termination modalities (e.g. in the event of improper service provision),
- agreement on the regime of the Commercial Code instead of the regime of the Civil Code (which causes a weakening of the customer’s position).
In any case, we recommend that you have the contract drawn up or at least checked by a good lawyer who is familiar with this area.
