Question
The employer sent me the notice by post, as a normal registered letter, which my wife picked up. Is such a statement valid?
The answer
According to Section 38 of the Labor Code, the employer’s documents on the establishment, amendment and termination of the employment relationship or the establishment, amendment and termination of the employee’s obligations under the employment contract must be sent to the employee in his own hands. Documents delivered by post are sent by the employer as a registered letter with a delivery note and the note "in my own hands" to the employee’s last known address. The foregoing provisions are intended to ensure that an ordinary registered letter, for example taken by the employee’s wife, such service is improper and therefore such termination is not valid.
