Does my employer have to pay me the same wage for working in the same position as my colleague?
The answer
The employer has a duty to negotiate wage terms that are non-discriminatory. In general, therefore, employees who perform the same work or work of equal value should be paid equally. However, this does not apply absolutely and in all circumstances. That principle does not preclude the differentiation of employees’ wages on the basis of an assessment of other objective criteria. The assessment of compliance with the principle of equal treatment in pay matters therefore depends on the circumstances of the particular case, which must be assessed on a case-by-case basis.
