Tenancy agreement - refund of deposit
upon change of ownership of the flat
Code: OBZM00113
Question
We rented a flat. During the term of the lease, the flat changed the owner. At the end of the lease, we asked the new owner to return the deposit we had paid (for possible damages), but he referred us to the original owner. Who should refund the security deposit?
The answer
The deposit is to be returned to the new owner of the flat. If they do not do so voluntarily, it is recommended that an attorney intervenes in the whole process on your side. It is possible that the new owner did not have the matter addressed in the contract on the transfer of ownership of the flat with the original owner, and therefore does not even know that the obligation to return the deposit is on him.
