Withdrawal from the succession agreement
Code: OBMA00108
Question
I would like to know whether it is possible to withdraw from the inheritance contract.
The answer
In our opinion, a validly concluded agreement between the heirs on the settlement of the succession can no longer be unilaterally revoked if such a possibility was not provided for in the inheritance contract itself (which is very unlikely). It is therefore necessary to carefully examine all the circumstances arising from the inheritance contract. It is advisable to consult a good lawyer who is familiar with the matter and can explain the content and consequences of the planned inheritance contract to the client. A small investment in such advice can then avoid surprises and disappointments.
